Currently, access to PeopleBrief content and newsletter subscriptions are provided free of charge.

Future Paid Services

  • All sales are final unless otherwise specified
  • We reserve the right to change pricing with notice

12. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Missouri and the United States, without regard to conflict of law principles. However, nothing in these Terms waives your rights under applicable consumer protection laws in your jurisdiction where such waivers are prohibited.

Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the site shall be brought exclusively in the state courts located in Christian County, Missouri, or the federal courts for the Western District of Missouri. You consent to the personal jurisdiction of such courts and waive any objection to venue.

Informal Resolution

Before filing any legal action, you agree to first contact us at legal@peoplebrief.net to attempt informal resolution. We will work in good faith to resolve disputes amicably for at least 30 days before either party may initiate formal proceedings.

Small Claims Court

Either party may bring an individual action in small claims court in a proper venue as an alternative to formal litigation.

Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration. If this class action waiver is found to be unenforceable, the entirety of this arbitration/dispute resolution provision shall be null and void.

Limitation Period

You agree that any claim or cause of action arising out of these Terms or use of the site must be filed within two (2) years after the claim arose, or be forever barred, except where applicable law requires a longer period.

13. California-Specific Provisions

Consumer Rights

If you are a California resident, you may have additional rights under California consumer protection laws, including the Consumer Legal Remedies Act (CLRA). Nothing in these Terms waives your rights under California law where such waivers are prohibited.

14. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PeopleBrief regarding use of the site and supersede all prior agreements, understandings, and communications.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.

Assignment

These Terms bind and inure to the benefit of the parties and their permitted successors and assigns.

Force Majeure

We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Headings

Section headings are for convenience only and do not affect interpretation of these Terms.

No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

Survival

Provisions that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Electronic Communications

You consent to receive electronic communications from us, including emails and notices posted on the site. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

These Terms are drafted in English. If translated, the English version controls in case of any conflict.
